    Capital Area Land Access Vote

I know this techniclly belongs in the "Central New York" sections, but seeing as how some of you have family or other land up my way or other reasons for coming up to the capital district area, it makes sence for me to put this here since it will affect all of OO in the end.

As some or most of you have seen, I am working on getting some access to some land that has been illegally use for some time now. My fight is mainly with RPI up here in Rennselaer/Troy, NY. I have come up with a list of reasonable things that I think everyone would be in agreement with to present to them when asking for legal permissable access to a couple hundred acres they have that are undeveloped at this time.

The area I am trying to gain access to is circled in red in the photo...

Here is what I am going to go to them with:

    We are seeking:
permission for unlimited access land that you own at (location)

We are willing to provide in return at no cost to you, the land owner:
    • provide an unofficial policing presence.
    • groom and maintain the trails
    • trails will have approximate markers for property boundaries
    • clean up garbage and debris in the trail area.
    • organize a clean up meeting once a month
    • provide a map of the trail system
    • will include property boundaries
    • all property we have permission to access
    • all trails found
    • updated as needed
    • provide a list of the community members that wish to have access and use the land responsibly.
    • The list will include, but will not be limited to
    • the members name
    • vehicle
    • year
    • make
    • model
    • plate number.
Additionally, we, the Members of the Outlawed Off-Road Community:
    • will not hold the Land Owners responsible or liable for any personal injury or damage to our personally owned vehicle that was caused from our sport on your land.
    • Will remain __________ minimum distance from buildings
I will also be asking them what it would take for them to say yes to us being able to use the land till they develope it. I think this is reasonable to offer in exchange for use of the land they are not using at the current moment.

    So the question is:

Would you agree to these terms to gain access to privately owned land?

thats what i am thinking, give back more than you are asking for and it is a win win for everyone. I had to throw in the liability part cuz i know that will become an issue later.

Here is a rough draft of what I am gonna try to get the land owners to agree to:

    gonna start here:

Members of the Outlawed Off-road 4x4 Community:

We, the undersigned land owners, grant you, the members of the Outlawed Off-road 4x4 Community, conditional, unlimited access to the property we own.

In exchange for permission granted, the Outlawed Off-road 4x4 Community members will:
    • provide an unofficial policing presence while on the property
    • groom and maintain the trails
    • clean up any and all garbage and debris found while using the trails.
    • organize a clean up meeting or enter the property with the intent of cleaning up at least once a month

If the members of the Outlawed Off-road 4x4 Community see or find evidence of any illegal activity, we will work with the local Police Department in anyway required. The members of the Outlawed Off-road 4x4 Community also acknowledge that this permission can be revoked or conditions can be changed at anytime as the land owner deems necessary.

The members of the Outlawed Off-road 4x4 Community further agree that the land owners will not in anyway be held responsible or liable for any personal injury or damage to the members vehicle sustained while on your property.

A copy of this letter will be provided to all members whom have access to the land.

    Sincerely,
    The Land Owners
if they dont go for it, the I will add:

    • provide a map of the trail system
if they still dont go for it, the i will add:

    • provide a list of the community members that wish to have access and use the land responsibly.
    • The list will include, but not be limited to:
    • the members name
    • vehicle
    • year
    • make
    • model
    • plate number.

The list will be updated on a monthly basis or as needed.

.... A copy of this letter will be provided to all members whom have access to the land and are on the attached list. An updated list will be provided after each clean up meeting.

Sounds good, maybe they could even use some of my forestry knowledge from college to do an assesment for the college about the land and timber value.
